TERMS OF SERVICE:
lumpypaca.com is owned by LumpyPaca, and maintained by both the owner and RAINO.
By requesting a commission from LumpyPaca, you are stating that you have read, understood carefully and accepted all the following terms below. The Terms of Service may be revised at any time, which revisions shall be binding upon you.
1. DISCORD
All commissions are discussed through Discord DM only.
2. PAYMENT
All payments are processed in Paypal only for international commissioners. Commissioners must pay 100% of the base price up-front after accepting rough sketch for Paca to start commission.
3. COMMUNICATION
- Please be respectful and cooperative when communicating, or when discussing commission. And please note Paca is not a native English speaker and will use translator during the work. Acknowledging this, please limit the uses of idioms, abbreviations, slangs, sophisticated words, sarcasm and etc…
- Paca does commissions by slots on the basis of first come, first served. Paca doesn’t accept any favours to prioritize a specific request over others.
- Paca usually responses to messages within 24 hours but may take longer when facing problems, and Paca will inform you first if this happens.
4. NSFW
No underaged commissioners are allowed for NSFW (18+) commissions. Requesting NSFW commissions confirms you are at least 18 years old, and is not Paca’s responsibility to check your age.
5. COMMISSION PROCESS
- When your slot is opened, Paca will reach out to you through Discord DM, and please give as many details as possible about your commission, such as character design, pose, outfit and etc… Paca will not draw original characters (or OCs in short) without the expressed written permission of the OC owners.
- Within 3 days, if no effort of communication is attempted when your slot is opened, or no payment is deposited after the rough sketch is finalized, your slot will be given up for the next in queue, no questions asked.
- Requesting only rough sketches or too many rough sketch revisions are not permitted.
- During the commission, you are not permitted to share any materials related to the process of the commission outside without permission from Paca.
6. REQUESTING ADJUSTMENTS
- Paca will work off the artistic freedom whenever possible, and you may request adjustments during the commission. Adjustment requests that are too difficult are not guaranteed to be accepted and may be rejected. Additional fees may incur from said changes, and you are expected to pay illustration fees from these adjustments unless for mistakes due to miscommunication from Paca’s side, in that case please inform Paca as soon as possible to avoid unexpected charges. Failing to pay the additional fees will result in refusal of the adjustment requests or cancellation of the commission.
- You are expected to read and response to Paca’s messages about the commission progress within 3 days, with a grace period of 4 days. Grace period may be granted in situations where commissioners are unable to reach out to Paca due to difficulties. In other words, you can have a maximum of 7 days or 1 week to reply to Paca for adjustment requests. Grace period is not automatically granted and must be requested before or during the commission, and can be rescinded for any reasons. After this period, Paca will assume you have accepted the progression of commission without needing to request adjustments and continue to work with artistic freedom. To avoid conflict with rule 2 of Term 5, this rule will only take effect after the base price of commission is fully deposited.
7. DECLINATION OF COMMISSION
Paca has the right to decline the commission request without needing to explain the reason, although Paca will likely explain out of courtesy. Breaching any of these Terms of Service may result in declination of all commission requests at current and future terms.
8. REFUND POLICY
No refunds will be given for any payments deposited, except under special circumstances where Paca cannot finish the commission. To address this, the unfinished work and partial refunds will be given based on the progress have been done on the commission, and the exact amount of refund is up to Paca to decide.
9. ARTISTIC LABOUR & CHARGEBACKS
By commissioning Paca, you are purchasing the artistic labour only, not a physical nor digital item. You also agree to give up any attempts of chargeback on Paypal, as you are confirming your access and/or ownership of the account and the payments. Any attempts of chargeback will be considered bad faith and will result in cancellation of commission.
10. CANCELLATION OF COMMISSION
Paca has the right to stop and cancel the commission for any reasons, and may not give refunds should there exists a breach of these Terms of Service.
11. INTELLECTUAL PROPERTY
- Paca reserves all copyrights over all original artworks, commission files, video clips, posts and other relevant information on this website. All non-original characters are copyrighted and protected of the respective owners.
ANY UNAUTHORISED USE OF THE COPYRIGHTED MATERIALS SUCH AS TRACING, EDITING, ALTERING, AI TRAINING, MINTING NFT, PIRATING, PROFITING OR USING THE COPYRIGHTED MATERIALS FOR COMMERCIAL USE IS STRICTLY PROHIBITED.
12. ARTIST RIGHTS
- Paca reserves rights to continue using the commissioned works for other purposes, including but not limited to: modifying, producing alternates, referencing, promoting on social medias, selling merchandise and etc…
- All commissions will be posted on Twitter (can be delayed at the request of commissioner), and all commission files (images, .clip, .psd and etc…) will be provided to Patreon subscribers.
13. COMMISSIONER RIGHTS
- You may use the commissioned work for personal uses only, such as displaying, profiles, personal prints, posting on social medias and etc…
- Paca does not permit any misuses of the commissioned work which would reflect discredit on the artist’s reputation, or which would violate the spirit of the commission.
- You may not incorporate the commissioned artworks in another work of art (or another artist’s commissions) without permission from Paca.
14. COMMENTS
Comments inside all posts are monitored by the website operators (Paca and RAINO). By submitting a comment, you shall be solely responsible for the consequence of your own comments. All comments are subjected to several restrictions: may not breach any of these Terms of Service; may not contain material that infringes on the intellectual property rights; may not contain information that are untrue, false or misleading; may not contain private information of you or others that is not publicly available; may not contain links or images that are destructive or harmful; may not be spams or any forms of comment that are not relevant to the post, artworks or Paca; may not be controversial, political or targeted towards protected groups of people; may not be any forms of roleplaying. Comments that violate these restrictions will be removed, and the person held responsible may be banned from commenting.
This term is only applied for website users for the purpose of moderation, and is not included for commissioners. Commissioners using the website is also counted as website users.
15. SHARING ARTWORKS
Please include and credit Paca’s twitter when sharing the commissioned artworks on social medias.
